Adeu Ambient Terms of Use

By using Ambient, you confirm that you are 18 or over and that you use it for your work, trade, business or profession.

Ambient is in early access. Features may change, be limited or be removed, and Ambient may not always work as expected. Do not rely on it as your only copy of important information, or as the only way to meet a deadline.

• We give you a limited, non-exclusive, non-transferable right to install and use Ambient on the devices your license covers, for the trial or license period.
• Keep your activation code to yourself or your organisation. Do not share or resell it.
• We may end a free trial at any time.
• Open-source components in Ambient are licensed under their own terms.

• You choose which accounts and services Ambient connects to. Connect only accounts you are allowed to use in this way.
• Ambient connects to third-party services at your request. Ambient is not affiliated with or endorsed by them. Your use of them remains subject to their terms, and you are responsible for complying with those terms.
• We are not responsible for services you choose to connect, or for what they do. This does not limit our responsibilities for the included AI service, including for Google as our subprocessor.

• Dealfluence claims no rights in your content or in what Ambient produces for you, subject to the rights of others and applicable law.
• Ambient keeps your content on your computer. We do not access it there, and we do not use your content to train AI models.
• You allow us to process content only as needed to provide the included AI service, as described in the privacy notice.

• Use Ambient lawfully. You are responsible for the content you process with it, including other people's personal data, and for having a lawful basis and informing people where the law requires it.
• Before recording a meeting, tell the participants, and get their consent where the law requires it. Rules differ between countries.
• Review drafts and other output before you send or rely on them. You are responsible for messages sent from your accounts, including messages sent under standing rules you create.
• Keep your devices secure, including disk encryption and operating system updates, and keep your sign-in details and activation code safe.

• AI output can be inaccurate or incomplete. It is not legal, financial or other professional advice.
• When you use the included AI service, you must also follow Google's Generative AI Prohibited Use Policy.
• Dealfluence provides one AI service with Ambient: the included AI service. We do not provide, operate or resell any other AI service, we have no agreement with any other AI provider for Ambient, and we do not endorse any particular AI provider.
• Ambient's settings let you connect a different AI service yourself, or let an AI app such as Claude Desktop use Ambient. If you do, you choose and contract with that provider, and you are responsible for that choice. Google user data, and anything derived from it, stays subject to Google's Limited Use requirements: choose a provider that uses it only to produce features for you and never to train or improve AI models. A provider's terms cannot permit other uses.

You must not use Ambient to:

• break the law or infringe other people's rights
• send spam or unsolicited bulk messages
• spread malware or attack other systems
• get around licensing, security or usage limits
• reverse engineer Ambient, except where the law allows it
• build a competing AI model using the included AI service
• use the included AI service in clinical practice or to give medical advice
• get around the included AI service's safety measures

Free trials are free. Paid licenses cost what we agree with you in your order, plus applicable taxes. Your order sets the license period, renewal and cancellation.

The Adeu Ambient Privacy Notice explains how data is handled. If you use Ambient for business purposes, including as a sole trader, our Data Processing Agreement forms part of these terms and governs how we process personal data for you in the included AI service, from the start. You can request a copy at privacy@adeu.ai.

Ambient, its software and the Adeu name belong to Dealfluence or its licensors. If you send us feedback, we may use it freely without any obligation to you.

To the extent the law allows, Ambient is provided “as is” and “as available”. We do not promise that it will be uninterrupted, error-free or accurate.

• To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of data, profit, revenue or business.
• Our total liability is limited to the greater of EUR 100 and the fees you paid us for Ambient in the 12 months before the claim.
• These limits do not apply where the law does not allow them, including liability for wilful misconduct or gross negligence.

• You can stop using Ambient at any time.
• We may suspend or end your access if you breach these terms, if there is a security risk, if the law requires it, or when early access ends. We will give notice where reasonable. If we end a paid license early for a reason other than your breach, we will refund the fees you prepaid for the unused period.
• When your license ends, your right to use Ambient ends. Your content stays on your computer. The sections on your content, liability and governing law continue to apply.

We may update these terms. We will tell you by email before a material change takes effect. If you keep using Ambient after that, the new terms apply. If you do not agree, stop using Ambient.

• These terms, our Data Processing Agreement where it applies, and any order you sign with us are the whole agreement about Ambient. If they conflict, the Data Processing Agreement prevails on data protection, the order prevails on commercial terms, and these terms prevail on everything else.
• If a part of these terms is invalid, the rest still applies.
• We may transfer these terms to a company that takes over Ambient. You may not transfer them without our consent.

Finnish law applies, without regard to its conflict-of-law rules. The Helsinki District Court is the court of first instance.
